These terms are an agreement between you and Ferrox Labs. Please read them carefully, because they cover important topics including the autonomous nature of the software, the absence of any warranty, and the limits on our liability.

Acceptance of terms

By accessing the Wayland website or by installing or using the Wayland software, you agree to these terms. If you do not agree, do not use the website or the software.

The software and license

The Wayland app and the Wayland-Core engine are free and open source, licensed under Apache-2.0. Your rights to the software code are granted by that license. These terms govern your use of this website and your use of the software, and they sit alongside the Apache-2.0 license rather than replacing it.

Beta software

Wayland is provided during active development. Features may change, break, or be removed at any time. We make no guarantee of availability, uptime, data retention, or that any particular feature will keep working. Treat it as beta software and plan accordingly.

Your account and security

You are responsible for safeguarding your credentials and your model provider API keys. Keep them private and secure. You are responsible for all activity that occurs under your account or with your keys.

Acceptable use

You agree to operate Wayland only on systems, accounts, and data that you own or are authorized to use. You agree not to use Wayland for anything illegal, and not to use it to harm others or to access, damage, or interfere with systems you do not control.

Autonomous agent and your responsibility

Wayland and Wayland-Core can act autonomously. They can execute commands, run code, read, write, and delete files, control other applications, agents, models, and CLIs, and send messages on channels you connect.

By using the software you authorize these actions. You are solely responsible for reviewing, supervising, and bearing the consequences of everything the software does on your behalf. The software can make mistakes and can act unpredictably. Run it only on systems and data where you accept that risk, keep backups, and supervise what it does.

Third-party services

Model providers and other tools you connect operate under their own terms. You are responsible for any usage charges they bill, for example model API costs. We are not responsible for the output, availability, or charges of any third-party service.

No warranty

The website and the software are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied. This includes, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error free, or secure.

Limitation of liability

To the maximum extent permitted by law, Ferrox Labs and its contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, or any costs incurred (including model or other third-party usage costs), arising from your use of the website or software, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability will not exceed the amount you paid us, which for the free software is zero.

Indemnification

You agree to indemnify and hold harmless Ferrox Labs and its contributors from any claims, damages, losses, and expenses arising out of your use of the software or your violation of these terms.

Termination

You may stop using the website and software at any time. We may suspend or end your access to the website or any hosted feature at any time, for any reason, including a violation of these terms. The sections that by their nature should survive, including warranty disclaimers, limitation of liability, and indemnification, will survive termination.

Changes to these terms

We may update these terms as Wayland evolves. When we make a material change, we will update the date at the top of this page. Your continued use of the website or software after a change means you accept the updated terms.
